Terms and conditions for using the information resources of the online portal
1. General provisions
1.1. This agreement on the terms of use of the information resources of the SRIBNA LAVKA online portal (hereinafter referred to as the Agreement) defines:
1.1.1. Rules for the use of the online portal (hereinafter referred to as the Portal) by visitors and users (hereinafter referred to as Users).
1.1.2. Terms of ordering Products.
1.1.3. Terms of use of personal data, as well as the rights of Users who have provided them.
1.2. The owner of the Portal is Sole Proprietor Magaiskyi O.V. Location: Zolotonosha, Shevchenko St. 96.
1.3. Use of the Portal by the User means acceptance of and agreement to comply with all terms of this Agreement.
1.4. This Agreement and the Portal may be changed by the Owner at any time without special notice to Users. The new version of the Agreement and Portal content become effective upon publication and updates.
2. Rules of use of the Portal by Users
2.1. The Portal contains intellectual property objects (including copyright objects, trademarks): photos, videos, graphic images, musical and audio works. Exclusive rights to use the Portal content (including selection, arrangement, systematization and transformation of data as well as source data), unless otherwise stated, belong to the Owner.
2.2. Users under 18 must obtain consent from parents or legal guardians to place an order. If guardians do not agree with any terms, the User must stop using the Portal.
2.3. Distribution, publication, or other use of Portal materials is not allowed without reference to the Owner (Portal link).
2.4. In case of violation of clause 2.3, the User is liable under applicable Ukrainian law.
2.5. The User agrees to use the Portal only for lawful purposes.
2.6. The User agrees not to post materials of the following nature:
2.6.1. Violating Ukrainian law, containing threats, insults, obscene content, or disturbing public order.
2.6.2. Violating rights, honor, dignity, or legally protected interests of others.
2.6.3. Containing calls for religious, racial, or national hatred or violence, or otherwise violating Ukrainian law.
2.7. The Owner is not responsible for Users’ personal opinions posted on the Portal.
2.8. The User agrees:
2.8.1. Not to use the Portal for advertising or promoting goods/services.
2.8.2. Not to upload materials protected by intellectual property law without written permission of the Owner.
2.8.3. Not to publish Portal materials in printed media without prior written consent.
2.8.4. Not to place Portal materials in search engines, databases, or electronic publications without permission.
2.9. The User is fully responsible for violations of this Agreement and must compensate any resulting damages.
2.10. The Owner may remove content posted in violation of this Agreement.
2.11. The Owner may block Users violating the Agreement without explanation.
2.12. In case of violation, all orders are considered canceled.
2.13. By using the Portal, the User confirms acceptance of this Agreement.
3. Terms of ordering Products
3.1. By ordering Products via the Portal, the User agrees to this Agreement.
3.2. Placing an order means full acceptance of the terms below.
3.3. The order date is the date of completing the electronic order form.
3.4. To place an order, the User must:
3.4.1. Open the Portal link “sribnalavka.com.ua”.
3.4.2. Select Products from the catalog.
3.4.3. The order consists of all selected items.
3.4.4. Order includes: product name, metal type and purity, weight, size, stone name, price, payment method, and User information (name, phone, email).
3.5. Placing an order confirms that the User is familiar with product characteristics and purchase terms.
3.6. The Owner forwards the order to the manufacturer/seller within 24 hours.
3.7. Order confirmation is sent via SMS.
3.8. After confirmation, the Owner contacts the User within 24 hours to clarify order details.
3.9. On the purchase date, the User must visit the store or delivery branch.
3.11. The order is canceled if the User does not appear within 5 calendar days.
3.12. The User must report incorrect order data at least one day before receipt.
3.13. The User may cancel the order before confirmation.
3.14. The User agrees to pay the full order amount upon purchase.
3.15. Payment method is selected during order or purchase.
3.16. Force majeure releases both parties from liability.
3.17. Disputes are resolved through negotiations or court under Ukrainian law.
4. Personal data usage
4.1. By providing personal data, the User consents to its processing under the Law of Ukraine “On Personal Data Protection”.
4.2. The purpose of data collection is communication with Users.
4.3. The User agrees to receive informational messages via email or SMS.
5. Final provisions
5.1. The Owner does not guarantee uninterrupted or error-free operation of the Portal.
5.2. The Owner is not responsible for technical failures, data loss, or third-party actions affecting access to the Portal.
5.3. Nothing in this Agreement establishes agency, partnership, or any other relationship not explicitly stated herein.
